By accessing or using the Bro-Tap mobile app and related services (the "Service"), you agree to these Terms of Service (the "Terms"). If you do not agree, do not use the Service.
2. Eligibility
You must be at least 16 years old to use the Service. You must have the legal capacity to enter into a binding agreement and must not be prohibited from using the Service by law.
3. Accounts and Security
You are responsible for the information you provide and for maintaining the confidentiality of your account. You must notify us promptly of any unauthorized use.
4. License and Ownership
We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial use. The Service and its content are owned by us or our licensors and are protected by intellectual property laws.
5. User Content and Data
You retain ownership of content you provide (such as profile information, interests, and messages). You grant us a license to host, store, process, and display your content solely to operate and improve the Service. You represent that you have the rights to provide any content or contact data you submit.
6. Friend and Contact Features
If you use contact matching or invite features, you represent that you have permission to contact those individuals. You are responsible for your communications, including SMS or phone calls, and for any carrier charges.
7. Prohibited Conduct
You agree not to:
- Harass, threaten, or abuse others.
- Send spam or unsolicited communications.
- Impersonate others or misrepresent your identity.
- Access or attempt to access the Service using automated means.
- Interfere with or disrupt the Service or its security.
- Use the Service for unlawful activities.
8. AI and Health Features
The Service may use AI to help extract interests and summarize communication style. AI output may be inaccurate. Health-related features are informational only and are not medical advice. The Service is not for emergency use.
9. Notifications and Messaging
You may receive push notifications and scheduled reminders. You can control notifications in device settings. Some messages may include information about your friends based on your settings and permissions.
10. Third-Party Services
The Service may integrate with third-party services (such as Firebase, Apple, Google, and data providers). Your use of those services is subject to their terms and policies. We are not responsible for third-party services.
11. Termination
You may stop using the Service at any time and request account deletion in the app. We may suspend or terminate your access if you violate these Terms or if required to protect the Service or users.
12. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind. We disclaim all warranties to the maximum extent permitted by law.
13. Limitation of Liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill. Our total liability for any claim is limited to the amount you paid us for the Service in the prior 12 months, if any.
14. Indemnification
You agree to defend, indemnify, and hold us harmless from claims arising out of your use of the Service or your violation of these Terms.
15. Governing Law and Venue
These Terms are governed by the laws of the jurisdiction where we are established, without regard to conflict of law rules. Any disputes will be resolved in the courts located in that jurisdiction.
16. Changes to These Terms
We may update these Terms from time to time. We will post the updated Terms with a new "Last updated" date. If changes are material, we will provide additional notice as required by law.
